Consultation for PBSA providers

The Scottish Government has published a consultation seeking information from PBSA (purpose-built student accommodation) providers on their current processes for students who wish to end their tenancy agreement early. The consultation also seeks feedback on what the impact of any legislation in relation to notice to quit periods would have on PBSA providers.

Most student let landlords will not be categorised as PBSA providers. It is only PBSA providers who should respond to the consultation.

A student let landlord will only be categorised as a PBSA provider if their tenancies meet the criteria for the “student let” exemption from the PRT (private residential tenancy) regime. This would be the case if:

  1. planning permission for the construction, conversion or change of use of the property was given on the basis that it would be used predominantly for housing students, and
  2. the landlord lets, or is entitled to let, at least 30 other bedroom spaces in the building/complex, and
  3. the landlord uses, or intends to use, the properties predominantly for the purpose of housing students.
